Tension and Reconstruction of Legality-Rationality-Legitimacy of Local Government Innovation in China
Reform and innovation are often caused by implementation of real legal system and the contraction between the needs of the public interest.However, the pursuit of the rationality of public interest is facing the tension of legality of the existing legal system.From theoretical perspective, it is caused by the conflicts among value orientations of the concepts of legality, rationality and legitimacy.By investigating the legal system as an important variable, it can be seen that,government innovation and technology innovation as well as the institutional innovation have different operating logics.And under this logic, the tension between rationally and legality of reform and innovation has three different modes.The reform and innovation of local government can balance the tension between three major factors through certain mechanism design, thus achieving the unity of legality, rationally and legitimacy of public interest orientation.
