Reflection on Restructuring China s Water Right System--Based on an Analysis of the Current Situation of Water Resource Utilization in the Yellow River Basin
Currently,the Yellow River Basin is facing a most serious water resource crisis.The contradiction between supply and demand of water resources in the Basin is being aggravated by water pollution and water waste.The reasons for this are many,among which China s faulty water right system is a crucial one.This paper,with the Yellow River Basin as a point of penetration for study,commences with an exposition of the defects of China s water right system,i.e.the ambiguous concept of water right,the void of water right subject,and wrong positioning of the government role.Next,through an analysis of the concept of water right,water right subject system and governmeat role positioning,the basic intension of water right is defined and the role of the government in handling water right-related matters is correctly positioned.Finally,using foreign water right management systems and their advanced experience for reference and applying Coase Theorem,and based on China s actualities,the water right allocation,China s water right management system and operating mechanism are elaborated with a view to rebuilding a water right system that accords with China s real conditions.
