The Transition of Administrative Litigation Pattern in China under the Background of Social Management Innovation

  Administrative Litigation Pattern is the framework and foundation of the systems of Administrative Litigation.The administrative litigation in China traditionally belongs to the typical inquisitorial system, which greatly emphasizes the guiding role of the judge, while ignores the subjective initiative and objective functions that the plaintiff and defendant played.With the historical background of innovational social management, this pattern of litigation is not coordinate with the development of modern democratic nomocracy in many aspects.So it needs targeted transition, and mainly as follows: The emergence of non-mandatory administrative action requires the diversification of Administrative Litigation Types; the Cooperative system of administrative model initiates the comprehensive transition of Administrative Litigation Structure; then, the pursuit of administrative benefits prompts the diversity of the Aim of Administrative Litigation.
