Countermeasures against Environment Pollution of Ballast Water
Marine environment pollution caused by shipsballast water which is considered as 1 of 4 major threats to worlds oceans is unobvious and irreversible.At present,obvious and acute pollution such as oil pollution,air pollution and other ocean pollution were paid attention to but the pollution of shipsballast water.This article introduces danger of pollution of ships ballast water and reviews the international efforts on ballast water control and management such as International Convention for the Control and Management of ShipsBallast Water and Sediments.The article analyzes the necessity to establish the shipsballast water pollution compensation fund for the mobile characteristic of ships and ocean,the high loss caused by pollution of shipsballast water and so on.To compensate the damage from shipsballast water pollution,the author designs the structure of the shipsballast water pollution compensation fund including its legal character and the scope of applicable ships and its contributions.Meanwhile the article analyzes whether China should ratify International Convention for the Control and Management of ShipsBallast Water and Sediments expected to enter into force before Dec 2009,what potential influences the convention will have and what legal countermeasures China should take.
