On the Improvement of Chinas Government Contract Privilege System

摘要：

The privilege of the administrative contract is a new type of administrative power with the characteristics of specificity, unilaterally, unity of power and obligation. Currently, our countrys administrative contract privileges have the defects in law of low legislation level, scattering, trivial and the lack of integrity. Therefore, from the perspective of maintaining social public interests and safeguarding the legitimate rights of the administrative counterpart and standardizing administrative bodys act, it is necessary to improve the Chinas government contract privilege system. Its starting point should be to establish a comprehensive and systematic regulation about the premise of the exercise of administrative contract privilege, content, subject, procedure and so on.
