The Researches on Divorced Womens Property Rights Protection System

摘要：

According to the social gender theory, there is social status inequality between man and women, gender inequality is the product of society, in turn, its further consolidated through religion, education, law. The women usually is at the disadvantage, so v/omen should obtain the special protection. But Chinese marriage law is lack of gender perspective, ignore of married woman have to bear a more family affairs, spend more time and energy in take care of children and elder. So marriage law should be revised to give the special protection for women, for example divorced property should be allcoted according to the proportion of pre-marital property original value. Legislative recommendations are in order to protect divorced women property rights, so that women can faced with an independent attitude of the new life after divorce.
