Rethinking on Definition of Administrative Responsibility Subjects
The legal responsibility concept is a key and basic one in the science of law. In comparison to the concept of administrative responsibility in the jurisprudence, currently the popular concept of the administrative responsibility in the science of administrative law in China narrows the category of the administrative responsibility subjects, which may not only mislead and confuse the students and the researchers of the science of law, but also hinder the development and perfection of the science of administrative law. It is no difference from getting caught in ones own trap and is useless either in theory or in practice. Therefore, in the science of administrative law the concept of administrative responsibility regressed to administrative legal responsibility and the administrative responsibility subjects regressed to the subjects of administrative legal relations should be the right way to choose. As a result, the concept of administrative responsibility might be kept united in the jurisprudence and the science of administrative law.
