Debate of Some Issues on Land Expropriation System
The land expropriating system in existence of our country was formed in term of planned economy when the State was constructed to develop. Its establishment and implement has offered potent ensure for the development and construction of socialist economy. However, in term of market economy, whatever the academic fundation it based on or the correlative system it confirmed, current land expropriating system can neither fit the demand of social development obviously nor satisfy the need of economic construction. Especially the principles, the purpose, the range, the procedure of land expropriation, the calculation of cost for land expropriation, the installment of peasants expropriated and the determination of the nature between expropriated land nature and compensation for expropriation. Therefore, the text was written, in premise of protecting existent finite farmland resources and in order to ensure the legal interests of peasants land proprietary rights, to debate and research the correlative problems in theory and practice of the current land expropriation system. It pointed out the sequent and social phenomenon caused by the existed problems and raised suggestions and manipulations to reform.
