Research on the Improvement of Administrative Law and Regulatory Policy of Enterprise Annuity in China
The likelihood of potential risks and market failure in the course of operating enterprise annuity requires our government to play a regulatory role. Thus, it is of great significance to improve a legal system of enterprise annuity operation and supervision. With the formulation of a series of laws and regulations, there is a two-centered legal system of enterprise annuity, which points out government regulatory regime and functions in detail. However, relevant administrative laws and regulatory policies are merely inferior and lack of authortities. Entry qualifications of corporate annuity are too high. Employees have to wait for a long time to obtain annuity benefits. The government lacks relevant taxation preferences and supervision on annuity fund investment. Therefore, in order to ensure the sound development of corporate annuity, clarification of the legal status of enterprise annuity is supposed to be combined with implementation details involved. Meanwhile, the government should establish a unified regulatory system and risk control mechanism.
