Analysis on Special Bottlenecks in Chinas Rule of Environmental Law

Since the reform and opening up of China, the rule of environmental law has achieved greater success. However, except for some common bottlenecks in the process of Chinas rule of law, such as lack of supervision of Constitution and constitutional litigation, no separation from the Party and the Government with the Party replacing the Government, there are some special bottlenecks in the rule of environmental law. On the implementation of the strategy of environmental protection, the economic development has been stressed and the environmental protection neglected; the prevention principle has not been effectively implemented, lacking accountability mechanisms; the cost of illegal environment acts are low, lacking public participation and effective external supervision mechanisms; the environmental legislation is in great quantity and in poor quality with no regulations on some areas; the environmental administrative system is not smooth with some environmental enforcement not in place. Therefore, China should make some adjustments responsively in the rule of environmental law.
