On the Righteousness of the Procedures of Welfare Administration--Taking the Subsistence Security System for Urban Residents as an Example
The proper procedures of welfare administration will efficiently avoid the misusage of the administrative power; and ensure that the rights and interests of an administrative counterpart will be achieved, and that the probability of occurrence of the disputes will be reduced, thus the performance of the policies of the public welfare will be improved. In order to structure the fair and efficient procedures of the welfare administration, it is necessary to integrate and analyze the righteousness of the procedures of welfare administration, and evaluate whether or not such procedure satisfies the rational expectation of the societal public according to certain standards. In this article, it is to raise six requirements on the righteousness of the procedures of welfare administration, in accordance with which the administrative procedures of the subsistence security system for Chinese urban residents shall be studied, the unjust factors in which will be analyzed. This article points out, starting from the specific purpose and function of the welfare administration, in order to effectively safeguard the welfare rights of citizens to be realized, the policy-makers shall enhance the participation in the administrative procedures of the social welfare by the applicants, adjust the ways to investigate welfare administration, change the ways and contents of the administrative public announcement, and expand the scope of the hearing.
