Judging the Government Behaviors from the Forced Demolition of Chinese Local Government
In the process of the urbanization, the local government also participated in the local economic construction as an important role. However, due to the lack of effective mechanism, many local governments appeared illegal acts of administrative demolishment by force during the urban renewal and the dangerous house removal work processes, causing the dual loss of physical and mental to the people of being relocated. This article attempts to point out the shortcomings of the current demolition system, by analyzing from the aspects of the responsibility and authority of the local government, law enforcement administration and the supervision system of the local government. Above all, this article suggests that the local governments should take actions as clear responsibility and authority, law enforcement administration, coordinate the agreement of relocation and moving back, set up the right views of the economic development and the correct achievements and so on, to solve the administrative demolishment by force effectively. Thus, making the use of local government powers according to law both to safeguard the legitimate interests of the local people and develop the local economic.
