Demands for the Rule of Law in Social Management Innovation in China
Social management innovation ought to be subject to the rule of law, in order to obtain its legitimacy and authority. At the same time, with the aim of efficiently advancing social management innovation, great efforts on the construction of the rule of law are in need: firstly, government should be empowered much more discretionary power and the principle of all that is not expressly prohibited may do should be established with some conditions. They can provide opportunity for social management innovation; secondly, the legislature should provide such principles as rights safeguard principle, social participation principle and cost-benefit principle, so as to restrict social management innovation; thirdly, incentive mechanism of social management innovation needs to be established to motivate government, social organizations and their relevant staff to participate in social management innovation.
