On Administrative Tendency of Residents Committee Based on Legal Texts in China
Current residents committee in China has an obvious feature of administration. The research must attach great importance to their institutional factors in order to know administration clearly. Though legal status of residents committee is stipulated explicitly in Constitution of P.R.C. and Organic Law of Urban Residents Committees of the P.R.C., its function in other legal texts has a little difference. According to the Constitution and Organic Law, residents committee is mass organizations of self-government at the grass-roots level, but they should undertake a lot of administrative tasks in other laws. In order to alleviate and eliminate the administrative tendency of residents committee, the government should take some measures from the legal system. In my opinion, these following measures are necessary to gain this aim. The government should draw a clear distinction between the government and residents committee, and establish cooperation mechanism between them. Meanwhile, the government should strengthen chance of residents participation. Then the goal set by mass self-government organization system in grass-root level can be achieved.
