Research on Datum System of Administrative Discretion in China

摘要：

In the modern administrative countries, in order to adapt to changing realities and guaranteeing individual justice, the administrative organs have been granted broad administrative discretion. The administrative discretion is a double-edged sword. Because it is open to abuse, it is necessary to be controlled, while the datum system of administrative discretion can reduce the abuse of the right of discretion. Establishing discretion datum system needs not only to refine and quantify the standards of administrative discretion but also to improve relevant supporting system, so that it can effectively run. The article firstly gives a summary of importance and necessity of administrative discretion and points the results of no control of discretion. Then the article presents a detailed plan of establishing administrative discretionary datum system.
