Study on the Qualification of Administrative Expropriation in Emergencies of China

摘要：

The implementation of administrative expropriation in the public emergencies should be strictly regulated by national legislation. Drawing on foreign legislative experience and Chinas national conditions, its premise should be defined as unexpected events; its purpose can only be limited to public interests; its decision-making body should be limited to the peoples governments above the county level, but the implementation body is less limited; and its object should include the property rights and labor service.
