The Roles of Governments Regulations on the Protection of National Brands under Foreign Merger and Acquisition

This paper analyses the protection of national brands from the aspects of industrial policies and government procurement under foreign merger and acquisition. Through quantizing and calculating the protection degree of industrial policies on stateowned and private auto industries and the density of products with independent brands, the empirical result shows that there is a negative correlation between two factors. The domestic and foreign experience indicates that the government procurement is essential for the protection of national brands, but many behaviors of government procurements are not operated properly in China. The authors suggest that the Government should improve the behaviors of government procurements and abandon the protection preferences of industrial policies for better protection of national brands under foreign M&A.
