The Construction of Legal System of Low-carbon Economy: Trends of Foreign Legislation of Low-carbon Economy and the Selection of China
Economy decides law, legal services in the economy. The development of low-carbon economy needs guidance, encourages, the standard and the safeguard of the state laws and regulations. On the global scale, in order to promote the development of low-carbon economy, there have been trends in the legal system of policy and gradually formed a legislative competition in the construction of legal system of low-carbon economy, various countries struggle the research to promote the related low-carbon legislation. At present, it is still in the relatively weak state about the construction of the relevant laws, regulations and policies in the field of development and utilization of low-carbon economy in China. By learning from advanced foreign experience in legislation and unifying our country current law system frame, we should make efforts in promulgating low-carbon economic law, creating carbon emissions and trade system, promoting the formation of carbon emissions trading market and strengthening tax and financial legislation associated with the low-carbon economy.
