Economic Analysis of Litigation Procedures
This paper deals with problems like litigation cost, litigation efficiency, comprehensive optimization of litigation cost and performance, and economic analysis of litigation policy. The purpose of litigation mechanism is to minimize the sum of direct cost and indirect cost in the process of litigation. Starting from the proportion of litigation cost and litigation earnings, litigation efficiency aims at obtaining the biggest profits from the least litigation cost input. From the point of view of litigants, although comprehensive optimization of litigation cost and efficiency no doubt involves objective factors like litigation system, costs and judgment results, whether the litigants implement effective and correct litigation acts the essential condition for litigation economy and decisive for the litigation procedures.
