Mood and Modality Analysis into Legal Translation from a Text-based Approach
This paper presents a study of the interpersonal resources deployed in the enactment of the relationship among parties in the context of Hong Kong legal text production drawing upon systemic functional theory (Halliday 1985, 1994; Halliday & Matthiessen 2004) and legal text translation studies. More specifically, it analyzes and compares a bilingual tenancy agreement (written in English and Chinese) regarding the systems of MOOD and MODALITY. Differences and similarities in the different choices for MOOD and MODALITY options of the two versions of this bilingual tenancy agreement are shown. Based on the analysis and comparison it was possible to provide system networks of English and Chinese versions of the tenancy agreement, which represent a paradigmatic (systemic) picture of the major choices available in the English and Chinese interpersonal systems. In addition, it is suggested that these system networks may be of help for the activity of translatingspecifically with respect to the translation of meanings of mood and modality. To support such suggestion, practical parameters for the translation of meanings of modality are offered and the translation of modal operators occurring in this tenancy agreement will be explored.
