Research on the Validity Claims of Technological Protection Measures (TPMs) of the Copyrights
The World Intellectual Property Organization (WIPO) Internet treaties, article 11 of WCT (WIPO Copyright Treaty) and article 18 of the WPPT (WIPO Performances and phonograms Treaty) call for the legal protection of TPMs. And the validity of the TPMs is the condition of legal protection, but there are no specific conditions or standards about the validity in the current legislations which are only provisions of principle. As a result, the judicial practices face the dilemma of the legal application. So, the paper explores the conditions of the validity claims, which are the accountability, compatibility, security, in order to ensure that we can balance the interests among copyright owners, users and social public.
