Preliminary Study on Some Issues about Legal System of Production Safety with Chinese Characteristics
Since reform and opening-up, China has made significant achievements on legalization of production safet, and preliminarily established a legal system of production safety. Whereas, there are still some problems in the existing legal system of production safety, such as unscientificness, incompleteness and poor flexibility. The fundamental problems to settle for improvement of the legal system of production safety include: the basic framework and contents of the legal system;borrow ideas from the experiences of developed countries in respect of law and regulations on occupational safety and health;equilibrium of rights and interests of various social factors of safety production;correlation among legislation, enforcement and implementation of laws;and as well as the environment of production safety in China, etc.
