The Legal Research of Domain Names

With the rapid development of information network of computer, an electronic commericial operation model—electronic commerce (E-commerce) has become the major means of transaction in trade activities. Domain names in E-commerce, which have tremendous commericial values, are the most fundamental on the internet. However, there are still many controversies as to the problem of whether domain names belonging to intellectual properties. What’s more, there are no definite regulations in both the international and domestic legal framework. But towards the more and more disputes of domain names, especially the conflicts between domain names and trademarks or business entities, the international community and each country have adopted different protective measures. The authors hold the view that from the perspectives of the characteristics of intangible property, intelligence-created fruits and exclusiveness, domain names should belong to the protective scope of intellectual property.
