The Study about Protection Models for Intellectual Property Innovation in Software Industry

Among a variety of protection models for intellectual property innovation in software industry, copyright law is most common to use, a common practice in today’s world. Patent protection is a new trend to appear in big software countries in recently years. As two kinds of typical protection patterns for software property, theory and practice have shown that the main drawback in traditional protection model of the Copyright Act is “inadequate, while the flaw in simple protection model of patent law is “too. The ideal protection mode is to build a new system of legal protection for software with the protection ways combination of copyright and patent, taking the both advantages and abandoning the both disadvantages; that is, carrying out specific legislation to implement software protection.
