Practical Confusions of Legal Safety Supervising Liabilities and Its Solving Ways in China
There are three laws administrating the legal duties for all stakeholders in construction safety management in China, which are Production Safety Law, Construction Law and Construction Safety Management Regulation. According to the Construction Safety Management Regulations, there are four liabilities of safety management for construction supervisor in China. The four liabilities include “Review, “Inspection, “Report and “Rectification. However, both academic research and project practice show that all the four liabilities are difficult to be implemented by construction supervisor. A survey among 20 experts from governments, owners, contractors and supervisors in China was conducted to investigate how to assess the policy effect of the legal safety liabilities and to solve the confusions in construction safety management. both the positive and the negative effects are generalized on the current situation and the future development in construction industry in China. Further, aiming to prevent accident and clarify the liabilities of all stakeholders in construction safety management, three possible solving ways are suggested and compared. Considering both the social and the economic environment in China, one recommendation policy improvement was given.
