Dispute Prevention and Resolution in International Construction Contract under the World Financial Crisis
China international construction undertakings have been very successful. However, under the international financial crisis and with the fluctuation of the oil price, it is facing or will still have many new problems and challenges, including the increase of the trade protectionism in the construction market in some countries, the decrease in the investment of infrastructure sectors or the interruption of some projects, the increase of the risk of the currency rate and interest rate, the late payment or even the failure of the contract execution, the possible conflict of interest due to the local unemployment, etc. The paper will deal with the issues mentioned above, combing the “Administrative Regulation on International Construction Project which was adopted and implemented in 2008 and the relevant laws and regulations, to explore and discuss how to control the risk and to prevent the dispute in the process of negotiation, signing and execution of the international construction contract, and ways of settling the disputes concerned through legal and other means, including mediation, arbitration and litigation.
