Research on Problems in Real Estate Development Land Planning Regulation in China

Basic systems of real estate development land planning regulation by the government include substantial land planning system, land planning regulation procedure, major measures of land planning regulation, etc. Major problems in real estate land planning regulation in China: irrational establishment of real estate development land planning; considerable overlap and intersection among planning of different levels; weak legal binding of land planning; inability of traditional land planning regulation system to coordinate conflict of interests in real estate development market; land planning legal system to be improved. The real estate land planning regulation concept of sustainable land resources management and human orientation should be established; carry out regional guidance and achieve functional division of area in real estate development; establish nationwide land planning guideline and local land planning standard by people’s governments of various levels; clearly define division of responsibility and coordination of the planning and realize comprehensive land regulation; establish a public participation system of land planning and enhance the transparency of basis of urban planning approval; perfect the land planning legal system.
