Inspiration of Qing Dynasty Water Conservancy Legislation for Contemporary Water Conservancy Legal Instruction
Through the analysis of the historical data material, the article reviews both the success and the failure of water conservancy legislation in Qing Dynasty and points out its practical significance. Qing government attached great importance to water conservancy and its legislation, which reflected governments request for the control of the river. On the set of administrative organization and the division of responsibility, the legislation not only clearly defined each responsibility but also called for mutual supervision and constraints. The legislation expressed the spirit of combining the rule of law and the rule by virtue, showing strong authoritarian ideology. The inspirations for contemporary water conservancy legal instruction are as follows: we should put the water conservancy legislation in a more important position. Besides, the legislation need reflect the demand of comprehensive management. Furthermore, we should continuously perfect the water conservancy management system which asked people acting in accordance with their roles, and mutual supervision and constraints. The government should strictly enforce the law on the basis of strengthening ideological and law education. Lastly, the government need continuously improve the scientific nature of legislation on the basis of democratic centralism.
