Criminal Liability of Master & Crew in Oil Pollution Cases A possible conflict between the Law of the Sea Convention (UNCLOS),MARPOL and the European Directive 2005/35/EC)

The purpose of this article is not to give a detailed analysis of the present civil/criminal liability regimes that deals with ship source oil pollution incidents; other speakers will be very much involved in that very theme on the occasion of the centennial celebration of the Dalian Maritime University. The present article will concentrate on whether there is a conflict between Public International Law, i.e. specific provisions from the UNCLOS and specific provisions from the MARPOL 73/78 treaty and the European Directive 2005/35/EC.
