Compulsory Liability Insurance on Carriage of Liquid and Dangerous Cargo by Costal and Inland Waters in China
Both of the Ordinance of Transportation in Costal and Inland Waters and the Ordinance on Prevention of Oceanic Environmental Pollution by Ships are under amendment by competent authority of China in recent years, in which a regime of compulsory liability on carriage of liquid or dangerous cargo in Chinese territorial waters would be considered. This paper will by starting from explaining the importance of the marine compulsory liability insurance in the pollution preventing legislation analyze the defects of the present prevention of pollution legislation and necessity and obstacles of the compulsory liability insurance on the liquid and dangerous cargo transportation, and finally present some suggestion for the amendment on the above two ordinances.
