The Era After Bunker Convention: is the Gap in China Regime for Compensating Victims of Vessel-Source Oil Spills Filled?

The International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001 (hereinafter referred to as Bunker Convention) came into force as of November 21,2008. From March 9,2009, the Bunker Convention became effective in China.1 The Bunker Convention aims to fill the one remaining significant gap in the international regime for compensating victims of vessel-source oil spills. Specifically, since the existing conventions covering oil spills do not include bunker oil spills from vessels other than tankers, the Bunker Convention has established a liability and compensation regime for spills of oil carried as fuel in ships bunkers.
