Criminal Liabilities Regimes Concerning Oil Pollution Comparative Study between U.S. and China

In the last decades, there have been a bundle of serious accidents resulting in the production of large amounts of oil into the marine environment. Since Exxon Valdez case, the criminalization of seafarers has overspread in the world. The criminal law is more and more recognized by international society as an appropriate response to violators. Hence, this paper is dedicated to elaborate the criminal liability of oil pollution under U.S. and Chinese law in a comparative study approach. Drawing on the successful experiences and lessons from criminal prosecution of seafarers under U.S. law system, China is situated to improve and perfect its own system that would better prevent the occurrence of ship-sourced oil spill.
