The Analysis of Criminalization of Marine Pollution From the Adoption by the European Union of the Directive on Ship-Source Pollution and on the Introduction of Sanctions for Infringements

This Paper, entitled The Analysis of Criminalization of Marine Pollution from the Adoption by the European Union of the Directive on Ship-Source Pollution and on the Introduction of Sanctions for Infringements by Meng Fang of China Classification Society (CCS), examines the increasing worldwide trend to protect the marine environment through criminal law that has caused high-profile row in the shipping industry. This analysis is conducted from the legal perspective of the current international legal framework that governs the prevention of marine pollution incidents as well as from the practical perspective of the implementation status of the relevant international conventions. It is the authors wish to provide some inspirations to the regulators and legislators in their commitment to developing effective measures for the protection of the marine environment and to advocate the role of the International Maritime Organization as the sole international forum for the deliberation and development of such measures.
