Research on the Chinese Mode of Organization Liability for Environmental Crimes
On the basis of discussing the theory concerning liability of organizational environmental crimes, and combined stipulation in the Article 364 of the Criminal Law of China, this paper analyzes shortcomings and optimization of the Chinese criminal liability imposed on the organizational commit environmental crimes. This paper believes that the shortcomings of Chinese criminal liability imposed on the organizations commit environmental crimes are mainly embodied in the incomplete system, unscientific set-up of mode of criminal liability and lack of necessary categorization of criminal liability. As for the optimization, this paper, tailing to the aforesaid shortcomings, gives suggestions regarding adopting mode of special legislation, optimization of current criminal liability and expanding category of criminal liability.
