On Civil liability of Land-sourced pollution to Marine Environment

The marine pollution, besides those resulting from the leakage of oil from ship and the dumping of ships wastes, is mainly caused by the land-based sources being discharged into the ocean directly or into the river joining the ocean. This phenomenon is especially severe in developing countries. This article aims to demonstrate the necessity of the civil action in the cases of the marine pollution from land-based source through analyzing the current situation, the causes and the current measures of preventing this land-based pollution in Bohai Sea. Also, it is attempted herein to discuss the civil subject of the marine pollution from land-based sources, the constitution of the damage caused by this sort of pollution and the calculation of such damage.
