Study on the establishment of ships ballast water pollution compensation fund
Marine environment pollution caused by ships ballast water which is considered as 1 of 4 major threats to worlds oceans is unobvious and irreversible. At present, obvious and acute pollution such as oil pollution, air pollution ant other ocean pollution were paid attention to but the pollution of ships ballast water. This article introduces danger of pollution of ships ballast water and reviews the international efforts on ballast water control and management such as International Convention for the Control and Management of Ships Ballast Water and Sediments. The article analysis the necessity to establish the ships ballast water pollution compensation fund from the mobile characteristic of ships and ocean, the high loss caused by pollution with ships ballast water and so on. To compensate the damage from ships ballast water pollution, the author designs the structure of the ships ballast water pollution compensation fund including its legal character and the scope of applicable ships and its contributions.
