Study on Pure Economic Loss Compensation on Marine Oil Pollution Damage-From the perspective of IOPC FUND
Pure economic loss usually causes serious consequential results, especially in the field of the marine oil pollution. Thus, it is desirable to design a reasonable system to protect the victim in the oil pollution occurred in ocean to reflect the development of the functions of Tort law; meanwhile, the system also should limit its scope to avoid the abuse of the pure economic loss compensation and make a reasonable distribution of the responsibilities, costs and dangers. Different legal systems have different ways to deal with this issue, and there are practices under related International Conventions as well. The article will summarize the general principle and path to deal with the issue with the Categorization methodology. And it is beneficial for general Tort law in the field of pure economic loss from this study.
