The Choice and Analysis of Claim for Compensation of Oil Pollution Damage Caused by Ships Collision

摘要：

The tort of oil pollution damage caused by ships collision shall bring out two claims for compensation simultaneously,namely the claim for compensation of oil pollution damage and the claim for compensation of ship collision, both the claims constitute overlapping claims. The claimant has the right to choose one claim to exercise on the basis of his interests and will,and different claim to be chosen shall lead to different legal consequence eventually.Using the method of comparative analysis, the paper compare and analyse difference of the both claims, demonstrate advantages and disadvantages about each claim,and raise the way how to choose the claim in the case of oil pollution damage caused by ships collision.
