A Study on Civil Claims by Administrations for Marine Pollution Compensation
In the current Chinese regulatory institutions of marine pollution compensation, the qualification of the state marine administrations civil claim has been argued for a long time. This paper discusses firstly the fundamental law theories and legal basis as to whether the state marine administration has the right to claim for marine pollution compensation, the object and claims; secondly, it discusses how to recognize the right marine administration for the state civil compensation, the object and specific rights and obligations in accordance with the marine pollution damages at present; thirdly, furthermore, it studies how to make claims more efficiently by reinforcing the administrative institutions in the coming future in China.
