Research on the Marine Pollution Public Interest Litigation
With speedy development of Chinese economy, modern life brings us comfort and facilitation. When we enjoy our sweet life, damage to environment and resource should be paid more attention, caused by the modern civilization. This situation is running in the opposite direction to the strategy of sustainable development and the fundamental interest of people. The problem of environment draws lots of attention from all circles of society, while the environment public interest litigation is come to be the focused issue in the judicial field. However, there is almost nothing about the environmental public interest litigation in Chinese legislation. In this paper, the author would first introduce the environment right as the foundation of the public interest litigation and, then give some advices on establishing the system of the marine pollution public interest litigation, combining with the characteristic of marine pollution cases. The aim is to make any citizen or civil group have the opportunity to protect our oceans.
