The Double Punishment System in Management of Vessel-Induced Pollution
With the development of shipping industry, the marine activities are increasingly growing. In the meanwhile, the cases of pollution from ships occur frequently, and some of them even make severe damage. The root of regulating this kind of phenomenon is to found the double punishment system in the management of vessel-induced pollution to inhibit the subject in pollution caused by ships and to prevent vesselinduced pollution. The double punishment system has been set down in detail in the punishment system; however, it has not been stipulated in detail in the administrative penalty system as one of the two important sanctions forms in the responsibility of public law, especially in management of vesselinduced pollution. Therefore, at present, it is the main task to draw the logic of double punishment system in penalty system to improve the double punishment system in administrative law, especially in management of vessel-induced pollution, and to form a complete system of legal sanctions. In the meanwhile, the related content in Marine Environment Protection Law of The Peoples Republic of China should be changed and made some additions and establish the double punishment system in order to provide the basis in top law of establishment and improvement in management of vessel-induced pollution. In this way, we can effectively control the business operated by units and personnel and optimize the double punishment system in the whole administrative law system, and get the goal of protection the marine environment.
