On the Legal Issues of Marine Environment Pollution caused by EOLV Dismantling

On a world scale, each year the number of vessels reaching the end of their lives is estimated to be between 600 to 7001.The technical progress, but especially the safety norms imposed by international conventions to protect the marine environment against pollution are going to substantially increase this number for the coming years. The fates reserved to the end-of-life vessels (hereinafter EOLV) are multiple. The increasing number of EOLV has put the matter of ship recycling in the public domain2, due to health and environmental reasons, which calls to adopt compulsory rules in order to amend or recycle them. However, on their last trip, many potential pollutions to the environmment exist. Although the ship dismantling activity exists for a long time, the awakening of international organizations to face problems linked to this activity is rather late, only in the beginning of the 21st century. Some International non-governmental organizations (NGO) like Greenpeace International were the first to pull the alarm bell in the middle of the 90s. Just to say that, about EOLV, the first problem was to define the legal framework in which they can be treated. The non-existence of a formal legal framework still can not prevent some countrieshaving) (?) some case-laws related to EOLV, e.g. the ex-Clemenceau, the ex-France, the Sea Beirut... The second problem concerning the EOLV, which catches the most attention is about the dismantlement for recycling of ships. The debate is launched due to the presence on board of vessels of some dangerous or hazardous products, and which can harm health and environment during the dismantling. The increasing numbers of EOLV has pushed the international responsible entities to act. Based on the foregoing reasons, When analyzing the marine environmental pollution produced by the ship whose age expires on the basis of analyzing and comparing the legal provisions available, it need to probe the legal issues in the process of dismantling the ship whose age expires, including responsible parties, limitation of liability, principle of attributing duty and so on.
