Constructing One Plan, Three Systems of Marine Oil Pollution Contingency in the Peoples Republic of China
One Plan, Three Systems for contingency plans is the contingency management system with Chinese characteristics. One Plan is the contingency plan for public contingency events in the state, and Three Systems is the contingency management system, operation mechanism and the rule of law. Shipboard oil pollution is a kind of public contingency events. Due to enormous destructive power of the shipboard oil polluting incidents to the marine environment, strengthening One Plan, Three Systems of Marine Oil Pollution Contingency in the Poples Republic of China is imminent. This article has disecussed the core issues of the marine oil spill contingency system from the approach of Three Systems drawing advanced lessons from foreign countries: (1)Judge the necessity of building the Peoples Republic of Chinas marine oil regulatory agencies from the view of system; (2)Analyse the problems of funding sources specialized concern to paticular place and how to implement on the initial stage from the point of view of operation mechanism for oil spill contingency mechanism; (3)Analyse how to coordinate contingency mechanisms and other laws from the legal point of view;Finally, analyse the relationship between One Plan and Three Systems in the aspect of oil spillage at sea.
