Legal issues from the Hebei Spirit oil spill incident
The incident of oil spill from M/T Hebei Spirit occurred on 7 December 2007 is the most serious incident of oil pollution from ships in the history in the Republic of Korea and was announced by the Korean government of as a national disaster. What attract the attentions of the international community are not only the significant damages caused by the incident, but also the various legal litigations which involve issues of criminal, civil and administrative law. This paper introduces the incident including the pollution damages caused thereby, the investigations into the incident, the legal litigations arising therefrom, and the assessment and settlement of claims for pollutions damages. It also analyses what China as one of the largest oil importing countries may learn from this incident and handling thereof.
