From “Anti-piracy to “Harmonious Symbiosis: Development Tendency of Digital Copyrighted Works’ Profit Mode
On Oct21st 2008, Microsoft released an update version of its Windows XP Professional (Win XP) called Windows Genuine Advantage (WGA) in China, whose function was to detect whether or not the users Win XP was genuine. The pirate version of Win XP could not pass the verification of W GA, and the desktop of this system would be enforced to turn into black once an hour as a result. In China, people from all social circles, especially a large number of netizens responded to the so called Microsoft ―Black-out screen‖ event. Most of them argued that MS W GA had violated various laws and regula tions; however, through an analysis of such event with some relative theories and cases, this article believes that MS WGA is a due action of Digital Right Management (DRM). From the angel of Intellectual Property Law, DRM is a kind of legit imate technical measure. Therefore, this article would like to illustrate the legitimacy of MS WGA by comparing it with the cases of Jiangmin corporation logical lock and SONY BMG. Though MS WGA is not an illegal action, most people in China evaluate such action negatively. This is similar to what has happened to the recording industry in the past few years, the recording industry had employed a variety of DRM in Internet music downloading in order to limit such usage. Unfortunately, these measures didnt succeed, but stirred heavy criticism. Recently, many record companies such as iTunes Store and Napster music store have begun to provide DRM free music for downloading, which shows a reform of operation and profit mode of digital copyrighted works. This article then summarizes the transformat ion of profit mode in the software industry. Some digital copyrighted works, such as antivirus software and office software, gain money through service and advertisement, which not only ensures the popularization and application of the digital copyrighted software, but also protects the profit of the software designers. Thus, this article concludes that a new commercial mode characterized by collaborative development is taking shape and will have a promising future.
