Tripartite Consultation in China: A First Step Towards Collective Bargaining?
Labour tripartite consultation has been widely established in China and is often referred to as collective bargaining by the government and the All China Federation of Trade Union. This article reviews its devel opment and structure, and examines its role in resolving labour disputes, labour regulation formulation and collective bargaining. The Chinese tripartite consultation is found to be different from that advocated by the Interna tional Labour Organisation due to its lack of neutrality, poor legal enforcement of consultation outcomes, the lack of independent workers representation, and its restricted responsibilities. Notwithstanding these major deficien cies we conclude that Chinese labour tripartite consultation is the first step towards a more genuine form of collective bargaining.
