Does the Chinese Bayh-Dole Act of 2002 have the Same Effect as the US Act on the Rising University Patenting?
This paper assesses whether the emulation of the US Bayh-Dole Act in China promotes university patenting. Following the research methodology of Mowery et al.5, we analyze the emergence background of the Chinese Act and then assess the growth of university patenting activities before and after promulgation of the Act of 2002. We find that the effect of the Chinese Act is consistent with that of the US one: it facilitates the university patentability but it is merely one of the factors behind the expansion of university patenting. Our research results also broaden the prior findings that the Act not only impacts on national leading universities like Tsinghua University but also provincial leading universities like Chongqing University.
