Risks for Overseas Consultants Working on Construction Projects in China

As an opened developing country, China is attracting more and more foreign investment, and many large construction projects have been carried out with international funding. Meanwhile many overseas construction consultants have been retained to advice clients on the various aspects of the management of projects. This management advice is often given in the unfamiliar context of the Chinese construction industry, Chinese legal and administrative systems, and Chinese culture. There is a real potential for divergence between what the overseas consultants consider to be normal practice and traditional management concepts in China. Accordingly, many risks exist for the unwary consultant in these fields.The paper explores the main risks for consultants working on construction projects, and provides some countermeasures under the FIDIC form of contract and the Chinese version of the Engineering and Construction Contract (ECC), based on the research and experience for FIDIC and ECC.
