THE MORAL BASIS AND PERSPECTIVES OF COMPARATIVE LAW A preliminary draft of advanced elementary thoughts
Introduction 1.Some more than eighty years earlier Georges Ripert had spoken about the moral rule in the law of obligations1.I share with him the idea, that without an element of morality arising either out of religion or philosophy2, the legal rule will necessarily result to tyranny and disorder3.I believe even more, that actually in the process of regulating human behavior and social life, everything has a moral aspect4, and that morality, even though it may be different from law, may guide the latter toward its correct orientation5.
