再论指导性案例效力的性质与保证
In this article,the author shall addresses these questions according to the institutionallogic of our legal system, from the perspective of comparative law, with aconstructive critical angle, sum up the historical experience of the judicial reform inChina, explore the effect, appropriate positioning of guiding cases and their rationales,and suggest principal recommendations for their use.If possible, I hope to take theabove problems as a fulcrum for generating useful concepts and theories for futureresearches and building the necessary foundation for further research in the future inbid to consolidate the establishment of guiding cases and let them integrate into ourlegal system.
